Introduction

These Terms and Conditions ("Terms") govern all transactions and interactions between Richard Wilson Fine Art & Graphics, Inc., also known as Richard Wilson Art ("Company," "we," "our," or "us"), and the purchaser or user ("you" or "buyer") of our artwork, prints, and related services. By purchasing, using, or collaborating with Richard Wilson Art, you agree to be bound by these Terms.

Intellectual Property

  1. Copyright Ownership
    All original artworks, fine prints, graphics, and related materials created and offered by Richard Wilson Art are protected by U.S. and international copyright laws. The Company retains all intellectual property rights, including copyrights and trademarks, associated with its artwork and creative content.

  2. Prohibition on Reproduction
    No artwork, print, graphic, or any portion thereof may be copied, reproduced, distributed, displayed, or used in any form, digitally or physically, without prior written consent from Richard Wilson Art. This includes, but is not limited to, photocopying, scanning, photographic reproduction, or digital replication.

  3. Limited License for Purchased Items
    When you purchase a physical original or print, you acquire ownership of the physical object only. This purchase does not transfer copyright or reproduction rights. You may display the purchased artwork for personal use; however, commercial use, resale for reproduction, or any derivative creation is strictly prohibited without explicit authorization in writing.

Sales and Shipping

  1. Order Acceptance
    All orders are subject to acceptance and availability. We reserve the right to refuse or cancel any order at our discretion.

  2. Pricing
    Prices are subject to change without notice. All payments are final once processed and confirmed.

  3. Shipping and Risk of Loss
    Risk of loss and title for items purchased pass to the buyer upon delivery to the carrier. Shipping times are estimates and are not guaranteed.

Collaborations and Commissions

  1. Work with Brands and Organizations
    For commissioned artwork or collaborative projects, specific agreements outlining deliverables, usage rights, and payment terms will be executed separately and incorporated by reference into these Terms.

  2. Usage Rights
    Unless expressly agreed upon, all commissioned or collaborative work remains the intellectual property of Richard Wilson Art and is subject to the same copyright protections as original artwork.

Liability

  1. Limitation of Liability
    Richard Wilson Art shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the purchase or use of our products or services.

  2. Warranty Disclaimer
    Artworks and prints are provided “as is.” We do not warrant that the colors or images will appear exactly as on screens or prints due to variations in monitor/display settings and printing processes.

Returns and Refunds

Returns and refunds are handled on a case-by-case basis. Original artworks are typically non-returnable. Prints and other products may be returned only if defective or damaged during shipping, subject to our review and approval.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law principles.

Changes to Terms

We reserve the right to modify or update these Terms at any time without prior notice. Continued use of our services or purchase of our products after changes constitutes your acceptance of the revised Terms.
